Program Abstract
Discovery is a significant stage in the litigation of a criminal fire incident. It is critical for a fire investigator to understand the discovery process in criminal proceedings so his/her investigative work, work product, and evidence recovery procedures comply with the rules of criminal discovery. Failure to understand the discovery process, including preserving materials for discovery and properly supplying materials in accordance with discovery rules can have serious ramifications for criminal cases and the fire investigator's career. This self-paced program is an introduction to discovery in criminal proceedings. It will address basic definitions, the criminal discovery process, the fire investigator's duties under discovery, and where issues may arise for the fire investigator related to discovery.
